Terms of Service
Effective date: to be set on counsel approval. These terms govern flatclaim.com and the FlatClaim service, operated by Oakwell Partners Inc., a British Columbia company.
What the service is
FlatClaim is software, with optional live assistance, that prepares an IEEPA duty-refund claim file from entry data you provide: a computed, validated CAPE declaration in CSV format, a claim total and interest estimate, step-by-step instructions for submitting the file in your own ACE Secure Data Portal account, and a tracker. The free eligibility check that precedes any payment tells you whether your entries qualify, whether a declaration already appears to cover them, and which eligibility bucket they fall into.
What the service is not
FlatClaim is not a licensed customs broker and does not provide customs brokerage services, legal advice, or file documents with CBP on your behalf. You remain solely responsible for the accuracy of your data, eligibility determinations, compliance with CBP rules, and submission in your own ACE account. We never request or accept ACE credentials, powers of attorney, or authority over your refund, which CBP pays directly to you.
Fees and guarantees
- Fees are flat, one-time, in US dollars, published at flatclaim.com/pricing, and due only after the free eligibility check.
- Refund guarantee: if your CAPE claim, filed by you, results in no refund: your fee back in full.
- Workmanship warranty: if CBP rejects your file for a format error, we regenerate it corrected, free, until it's accepted.

Your data
Entry data is used solely to prepare your claim, encrypted, and purged after your refund lands, as described in the Privacy Policy.
Liability, disputes, governing law
